The former senator is accused of pocketing P183 million in kickbacks out of his pork barrel disbursements that went to fake projects, purportedly with help from alleged scam mastermind Janet Lim Napoles.
Estrada, through his lawyers, paid a P1.33-million bail – P1 million for his plunder charge, as set by the Special 5th Division which granted his bail petition on Friday; and P330,000 for 11 counts of graft or P33,000 for each count.
He had been detained at the Philippine National Police headquarters in Camp Crame since 2014 on allegations that he pocketed P183 million in kickbacks from fake projects, purportedly with help from businesswoman Janet Lim Napoles, the alleged scam mastermind.
Estrada, again asserted his innocence as he attended his first public mass since release following more than three years in detention over his alleged involvement in the "pork barrel" scam. Estrada's lawyer, Alexis Abastillas-Suarez, arrived in court before 9 am. They were only able to pay bail at 10 am due to some confusion in procedure.
Abastillas-Suarez said the bail grant is an indication of a weak case against Estrada.
"Ever since naman sinasabi namin (we have been saying that) the evidence against him is not strong....Because the evidence of the prosecution in the bail hearing will be adopted by the court in the trial of the case," Suarez said.
Suarez told the media that Estrada will have lunch with his family after his release. He will hear mass with his family, friends, and supporters at the St John the Baptist Church in San Juan at 3 pm.
"Bahala na po ang Diyos sa kanila... Wala po akong kasalanan," he said.
The court promulgated the decision Friday afternoon, September 15, and sent its sherriff to the Philippine National Police Custodial Center in Camp Crame where Estrada was detained just after 4 pmv
“Although there is evidence to show that there were glaring irregularities in the disbursement of accused Estrada’s PDAF allocations and that he received a sum of money from his participation in these irregularities, there is no strong evidence to show that he is the main plunderer within the contemplation of the plunder law and as alleged in the information,” the court said.
Estrada was detained in Camp Crame on June 23, 2014. When the 5th Division issued his warrant of arrest, he did not surrender to the court but instead to his father, former president now Manila Mayor Joseph Estrada.
"The President knows what he is talking about dahil being a prosecutor before, alam niya siguro, nabasa niya ang aming kaso. Talagang wala naman talaga, pinili lang talaga kami kasi we were with the opposition in the last administration," Estrada said in an ambush interview.
"Halos karamihan ng mga senador at congressmen, pumipirma din ng endorsement letters. Di namin malaman, tatlo lang kaming pinili ng SOJ (Secretary of Justice) nung draw samantalang ang mga kaalyado ng dating administrasyon parang di 'ata nabibigyan ng karampatang kaso," Estrada said.
